Fathers and mothers who are municipal or state employees, and now civil servants in general, are entitled to reduced working hours for the purpose of accompanying their child(ren) with a diagnosis of autism to therapy.
The Superior Labor Court, in ruling on RR-1432-47.2019.5.22.0003, guaranteed parents of autistic children a reduction in working hours, without a reduction in their pay or the need to make up hours later, in order to guarantee the continuity of treatment prescribed as a result of therapy for people with autism.
This guarantee was initially only for federal civil servants and was extended by the Supreme Court, in December 2022, to state and municipal civil servants. But recently, the TST ruled that this guarantee is not incompatible with the CLT.
