It is possible to grow cannabis sativa at home, in certain cases, without committing a crime

A recent decision, which standardized the understanding of the STJ's Criminal Panels, deals with the controversial issue of domestic cultivation of the Cannabis sativa plant for medicinal purposes. In the judgment, the omission of ANVISA and the Ministry of Health with regard to regulation was assessed and, thus, the criminal atypicality of the conduct was considered.
