Workers' Food Program (PAT): Is restricting the PAT deduction illegal?

The STJ, when analyzing art. 186, of Decree no. 10.854/2021, understood that it is illegal to deduct amounts paid as food, limited to the maximum amount 01 one minimum wage.
According to the Court, such limitations on deductions are not expressly set out in the laws that created the Food Program (PAT) and cannot be established by regulatory decree, even if the regulated laws contain a general regulation clause.
Therefore, the Workers' Food Program - PAT - should not have its deduction restricted
to the limit of 01 minimum wage for workers earning up to 05 minimum wages.
