On Tuesday, December 5, the Official Gazette of the State of Paraíba published Law No. 12.939/23, bringing with it significant regulations for the delivery service to apartments in vertical condominiums. The main innovation of this legislation is the prohibition, in certain circumstances, of consumers demanding that delivery drivers go up to the apartment door. Let's explore the main points of this law and its implications.
The crux of the legislation lies in Article 2, which explicitly prohibits consumers from demanding that app deliverers go up to the apartment door or enter common spaces in vertical condominiums. According to the law, parcels, if already paid for, must be delivered exclusively to the condominium entrance.
In order to ensure that the new rules are disseminated, Article 3 establishes that delivery platforms must give fixed and explicit notice, via the app, that couriers will not be required to raise their prices. This measure is intended to guide and clarify consumers, avoiding unnecessary conflicts.
If consumers want the delivery person to walk up to their door, they must ask for a tip. Only if the delivery person accepts the tip will they be obliged to go upstairs, providing a flexible approach that takes users' preferences into account.
The legislator has also contemplated special cases in Article 4. In situations involving consumers with reduced mobility or special needs, the delivery person is allowed to decide whether or not to enter the condominium to deliver the product. If not, the responsibility falls on the condominium, which must provide its own employee to make the delivery.
Law No. 12.939/23 in Paraíba brings significant innovations to the scenario of deliveries in vertical condominiums, balancing the rights of consumers with the operational logistics of delivery companies. The flexible approach, combined with clear notifications, seeks to minimize conflicts and provide an efficient and satisfactory service for all parties involved. It now remains to be seen how this legislation will be applied in practice and what impact it will have on the delivery sector in the state.
