Plastic surgery is becoming increasingly popular and can now be covered by the health insurance plan when it has a restorative or functional purpose and is indicated by the doctor for post-bariatric surgery patients. In addition to making it compulsory in cases of reconstructive surgery, the court also ruled that if there is any doubt that the plastic surgery is only for aesthetic purposes, the post-bariatric patient can make use of the medical board's procedure, as long as they pay the respective professionals' fees.

If the medical board's opinion is contrary to the request, the beneficiary can file a lawsuit, since the judge is not restricted to such an opinion to rule in favor of the beneficiary and force the health plan to cover it.
