Recently, the STJ ruled on the case of a passenger who, in 2014, was robbed at gunpoint in a subway station.



In the case, the court held that the failure to provide services was proven, due to the lack of a monitoring device at the location, generating the duty to indemnify.



The court held that a public transport service concessionaire should be held liable for damages suffered by passengers on the premises of a subway station in the event of an armed robbery and it is proven that there was a failure to provide the service, such as the lack of minimum security procedures.
