The classification "MEDICAL ERROR" should no longer be used in lawsuits that deal with liability for damages caused by possible failures in health services, since the National Council of Justice (CNJ) accepted the request of medical organizations that claimed that the use of the term, in itself, would be an anticipation of the guilt of the accused professional.



Thus, by using this expression, even after it has been established that there was no fault, the professional's name would be linked to the term, considerably damaging his reputation. In view of this, the CNJ considered the situation to be a historical distortion and the term should not be used
